Can I sue based on delays incurred to my construction project?

Expanding a business can be exciting, but helping an entity grow can require the significant investment of resources on the part of the business owner. Growth in the business world can include acquiring more labor, purchasing more inventory and building more business space.

Businesses that decide to build new facilities or to build onto their existing facilities often enter into construction management contracts with providers who offer those services. As most business owners lack both the time and expertise to manage their own building projects, construction management firms can offer day-to-day supervision of the ongoing build. When a business enlists the help of a construction manager or management firm it will generally enter into a contract with that entity to stipulate the terms of their relationship.

Construction management contracts can include terms regarding the project's scope and intended timeline for completion. One common dispute that often arises under construction management contracts is the failure of the manager to deliver the new building project to the business owner within the timeframe contemplated by their agreement. When a building project is late a court will evaluate many factors, such as the elements that caused the projects delay and whether the delays could have been avoided, before deciding if liability exists on the part of the construction manager.

Businesses that expand often experience growing pains and construction management disputes can contribute to those growth-related trials. Whether a business owner will be able to be compensated for losses due to delays under a construction management agreement will be factually driven based on each individual case.
