Many choose power of attorney options to protect their estates

A person's estate is the legacy that the person will pass on when the individual is no longer part of the living world. In New Jersey and in other jurisdictions throughout the United States, a person may want to hold on to has much control as possible regarding the decisions that must be made with regard to the person's estate plan. However, not all individuals are able to manage their own estate and financial matters until the ends of the lives and therefore some people require help to ensure that their legacies are well-executed.

One way that a person can provide security over the person's estate matters is by appointing a power of attorney. Power of attorney gives someone else the power to make decisions for another when the individual who grants power of attorney becomes incapacitated or otherwise unable to function. Power of attorney rights can extend to financial matters, health care decisions and other important areas of living.

Granting power of attorney rights to someone generally requires codification. A person cannot claim that he has power of attorney rights over an incapacitated person without some evidence that the debilitated person intended for the person to have them. This prevents unscrupulous individuals from taking advantage of those who are unable to care for themselves.

Individuals who would like to grant power of attorney rights to others may wish to speak with their estate planning professionals. Power of attorney rights and estates go hand in hand as they permit a trusted person to make decisions about another's finances and health. Choosing the right person to hold power of attorney rights over a personal estate can help protect the estate's wealth and the wishes of the person whose legacy is subject to damage.
