New Jersey contractor illegally negotiated with homeowner

In 2012, many New Jersey homeowners were impacted by Superstorm Sandy. When a homeowner is facing unexpected damage to their home, they can sometimes be vulnerable to contractors who come in to take care of the work that needs to be done. It is important for homeowners to understand their rights in contract negotiations, especially when they may be in a vulnerable state-of-mind.

A contractor here in New Jersey was negotiating a contract with a homeowner to repair damage done during Sandy. With the immediate need for new business, many contractors flooded the area without properly registering with the state. The homeowner was negotiating a contract with the contractor for work that wasn't completed.

The Ocean County consumer affairs office took the contractor to court and he was fined $2,500 and ordered to pay $385 in restitution plus court costs.

If one fails to register as a home improvement contractor in New Jersey, they can be fined up to $7,500 and sentenced to up to 18 months in jail.

It is important that when one is entering into any type of contract that they understand all of their rights and responsibilities. Doing the research up-front can oftentimes prevent issues and problems down the line. However, even the most thorough contract can be materially breached. In those cases, it is important that individuals know they have rights of recourse to have the contract carried out or be compensated for the damages for the breach of the contract.
