New Jersey couple accuses realtor of breach of contract

A New Jersey couple signed a listing agreement with a realtor from Coldwell Banker to handle the sale of their home. As time went on and the house failed to sell, the couple discovered something that caused them to file a breach of contract lawsuit against two realtors and the company. It is their belief that the realtor intentionally overpriced their house to keep it from selling.

The couple had security cameras in their home. What those security cameras apparently recorded outraged the husband and wife. Their realtor was allegedly using their home to have an affair with another realtor. Cameras recorded reportedly the two realtors entering the home and using the master bedroom for their tryst.

Since this incident became known, Coldwell Banker says the two realtors in question are no longer with the company. However, that has not stopped the lawsuit from moving forward. In fact, the couple is seeking punitive damages due to the seemingly egregious nature of the allegations.

Selling a home can be a stressful experience even under the best circumstances. New Jersey homeowners hire realtors to provide expertise on matters such as what can be done to make a house more appealing to buyers and to determine a marketable sale price. No one, including this couple, anticipates a realtor's motive to be acting professionally and perhaps hoping to maximize their commission. If a realtor fails to comply with his or her contractual obligations, the party or parties claiming financial loss may seek restitution through the filing of a breach of contract claim.
